Faulty components not reported

Hi,
Performing a check for clear space above stairs, I have noticed that one component is not beeing listed as an error, even though it fulfills the criteria to be an error.

The height above the stair should be 2,10m, whereas the element is only 1,21m above it. This Element (Beam) is mostly above the landing and partially above the raiser.
Am I doing something wrong here or the software?
